Terms and Conditions for Apartment im Winkel


1. Scope


 These General Terms and Conditions (GTC) apply to all contracts for the temporary letting of the apartment Apartment im Winkel / Winkelstrasse 23, 5734 Reinach to guests as well as to all related services provided by the landlord.


2. Conclusion of the contract


The rental agreement is concluded upon the guest's booking request and the landlord's written booking confirmation (via email, booking platform, or in writing). By booking, the guest accepts these terms and conditions.


3. Prices and payment terms


  • All prices are in CHF, including statutory taxes, unless otherwise stated.
  • The price for ‘children’ applies up to and including the age of 12.
  • Children under two years of age are free of charge.
  • The following payment terms apply:
  • Deposit: 50% within 7 days of booking confirmation
  • Final payment: no later than 14 days before arrival
  • For short-notice bookings (e.g. less than 14 days before arrival), the total amount is due immediately.

4. Arrival and Departure

  • Check-in on the day of arrival from 3:00 pm
  • Check-out on the day of departure is by 11:00 AM.
  • Deviations are only possible after prior agreement.


5. Use of the holiday apartment


  • The holiday apartment may only be used by the number of people specified in the booking.
  • Subletting is not permitted.
  • Pets are not allowed.
  • Smoking is not allowed in the apartment.
  • The guest agrees to treat the apartment, the inventory and communal facilities with care.


6. Cancellation by the guest


Cancellations must be made in writing (via email). The date of receipt by the landlord is decisive.

The following cancellation fees apply:

  •  Up to 7 days before arrival: free of charge
  • 2 to 6 days before arrival: 50% of the rental price
  • Less than 24 hours before arrival or no-show: 100% of the rental price

 We recommend taking out travel cancellation insurance.


7. Cancellation by the landlord

 

The landlord may terminate the contract for important reasons (e.g., force majeure, unforeseen damage to the accommodation). Any payments already made will be fully refunded. Further claims are excluded.


8. Liability


The landlord is only liable for damages caused by intentional or grossly negligent conduct. No liability is assumed for loss of or damage to the guest's personal belongings.


9. Notice of Defects


Any defects must be reported to the landlord immediately so that they can be remedied. If the guest fails to report the defects, no claims can be made.


10. House Rules


The house rules are an integral part of these terms and conditions and must be strictly observed.


11. Data Protection


 Personal data is processed in accordance with the Swiss Federal Act on Data Protection (FADP). Further information can be found in the privacy policy.


12. Applicable Law and Jurisdiction


 Swiss law applies exclusively. The place of jurisdiction is Reinach / Aargau, insofar as legally permissible.



AGB für Apartment im Winkel

1. Geltungsbereich

Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Verträge über die zeitweise Überlassung der Wohnung Apartment im Winkel / Winkelstrasse 23, 5734 Reinach an Gäste sowie für alle damit zusammenhängenden Leistungen des Vermieters.

2. Vertragsabschluss

Der Mietvertrag kommt durch die Buchungsanfrage des Gastes und die schriftliche Buchungsbestätigung des Vermieters (per E-Mail, Buchungsplattform oder schriftlich) zustande. Mit der Buchung akzeptiert der Gast diese AGB.

3. Preise und Zahlungsbedingungen

  • Alle Preise verstehen sich in CHF, inklusive der gesetzlichen Abgaben, sofern nicht anders angegeben.
  • Es gelten folgende Zahlungsbedingungen: o Anzahlung: 50 % innerhalb von 7 Tagen nach Buchungsbestätigung o Restzahlung: spätestens 14 Tage vor Anreise
  • Bei kurzfristigen Buchungen (z. B. weniger als 14 Tage vor Anreise) ist der Gesamtbetrag sofort fällig.

4. An- und Abreise

  • Check-in am Anreisetag ab 15.00 Uhr
  • Check-out am Abreisetag bis 11.00 Uhr
  • Abweichungen sind nur nach vorheriger Absprache möglich.

5. Nutzung der Ferienwohnung

  • Die Ferienwohnung darf nur von der bei der Buchung angegebenen Personenzahl genutzt werden.
  • Untervermietung ist nicht gestattet.
  • Haustiere sind nicht erlaubt.
  • Rauchen ist in der Wohnung nicht erlaubt.
  • Der Gast verpflichtet sich, die Wohnung, das Inventar und gemeinschaftliche Einrichtungen sorgfältig zu behandeln.

6. Rücktritt / Annullierung durch den Gast

Eine Annullierung muss schriftlich (per E-Mail) erfolgen. Massgeblich ist der Zeitpunkt des Eingangs beim Vermieter. Es gelten folgende Annullationskosten:

  • bis 7 Tage vor Anreise: kostenfrei
  • 2 bis 6 Tage vor Anreise: 50 % des Mietpreises
  • Weniger als 24 Stunden vor Anreise oder No-Show: 100 % des Mietpreises

Wir empfehlen den Abschluss einer Reise-Annullationsversicherung.

7. Rücktritt durch den Vermieter

Der Vermieter kann den Vertrag aus wichtigen Gründen (z. B. höhere Gewalt, unvorhersehbare Schäden an der Unterkunft) auflösen. Bereits geleistete Zahlungen werden vollständig zurückerstattet. Weitere Ansprüche sind ausgeschlossen.

8. Haftung

Der Vermieter haftet nur für Schäden, die durch vorsätzliches oder grobfahrlässiges Verhalten verursacht wurden. Für Verlust oder Beschädigung von persönlichen Gegenständen des Gastes wird keine Haftung übernommen.

9. Mängelanzeige

Allfällige Mängel sind dem Vermieter unverzüglich anzuzeigen, damit Abhilfe geschaffen werden kann. Unterlässt der Gast die Anzeige, bestehen keine Ansprüche.

10. Hausordnung

Die Hausordnung ist Bestandteil dieser AGB und zwingend einzuhalten.

11. Datenschutz

Die Verarbeitung personenbezogener Daten erfolgt gemäss dem Schweizer Datenschutzgesetz (DSG). Weitere Informationen sind der Datenschutzerklärung zu entnehmen.

12. Anwendbares Recht und Gerichtsstand

Es gilt ausschliesslich Schweizer Recht. Gerichtsstand ist Reinach / Aargau, soweit gesetzlich zulässig.
